Terms of Service

1. Who we are, and what these terms cover
Highlander is operated by Hauke Jung, Hauptstr. 41, 79199 Kirchzarten, Germany ("we", "us"). Full details are in the Imprint.
These Terms govern all use of Highlander at https://highlander.lol, including the board, the entry form, the listing pages, the dashboard, the API and the MCP endpoint. By submitting a listing or buying years, you agree to them.
There is one role and one direction of money. You are a Lister: you submit a link, it appears on our board, and we deliver visitors to it. Nobody is paid out by us. We do not operate a revenue share, we do not host anything on your website, and we are not an intermediary between you and any third party.
2. Business customers only
Highlander is offered exclusively to entrepreneurs within the meaning of § 14 BGB, to legal persons under public law, and to special funds under public law. It is not offered to consumers within the meaning of § 13 BGB.
By using Highlander you confirm that you are acting in the exercise of your trade, business, craft or profession. Checkout requires a billing address and collects a business tax identification number wherever the jurisdiction supports one. Because the service is not offered to consumers, the right of withdrawal under §§ 312g, 355 BGB does not apply to a purchase of years.
If, despite the above, you are in fact acting as a consumer, your mandatory statutory rights are unaffected. Nothing in these Terms excludes or limits rights that cannot lawfully be excluded or limited.
3. Accounts
An account is optional. Submitting a listing requires none.
- An account is needed to manage a listing's daily cap, to lift a freeze, to report another listing, and to see your listings in one place.
- You must be at least 18 and have capacity to enter into contracts. Registration requires accurate information, kept current.
- Authentication is provided by FerrisKey. You are responsible for safeguarding your credentials and for everything done under your account.
- Tell us immediately at mail@haukejung.de if you suspect unauthorised access.
- We may suspend or close accounts that breach these Terms or create legal or security risk.
4. Entering: your listing, and proving the domain
- You may submit a link only if you own the destination or are authorised to place it on a public board. Submitting a domain you do not control is a breach of these Terms.
- A submission is checked automatically before it exists: reserved names are refused, the destination must resolve and return a page with a title, only one live listing may exist per registrable domain, and a domain registered less than seven days earlier is refused. A run of near-identical submissions inside one hour is held.
- A submitted listing sits in The Mists: it exists, it is unranked, and it does not appear on the board at any position. It leaves the Mists when you prove control of the domain by publishing the DNS TXT record shown on its page, or when a purchase of years for it completes (§ 6).
- On leaving the Mists a listing receives a free grant of 250 years. It is granted once per listing and has no cash value.
- You may change a listing's daily cap at any time from the dashboard, subject to the minimum shown there. Nobody but you can change it.
5. Years: what you buy, and what it is not
A year is a unit of delivery, bought in advance. Years are sold in fixed packs at the prices posted on the buy panel. They entitle you to have your listing carried on the board and to have visitors delivered to it, and to nothing else.
- Years are consumed only by delivery. One year per click delivered to your listing, and ten years per day your listing stands on the board (upkeep). There is no other way a year is spent.
- Years never move between listings. There is no transfer, no wager, no challenge, no pot, and no mechanism by which one listing's balance can be taken by, given to, or staked against another. Where a listing is removed from the board, its remaining years are extinguished and nobody receives them.
- Rank is a consequence, not a product. Listings are ordered by years remaining. We do not sell a position, and we do not guarantee one. Because the listings above you are being consumed at a rate we do not control, your position may change at any time in either direction without anything happening to your own balance.
- Nothing you buy moves a deadline. A Gathering's closing time is fixed when it opens and no purchase, of any size, changes it.
- Years have no cash value, are not a payment instrument, are not redeemable for money, and cannot be sold or transferred to another person.
6. Delivery: what counts as a click
A click delivered is a visitor being redirected from your listing on our board to your destination URL.
- Whether a click is charged is decided by automated checks that look at the request itself: it must be a genuine browser navigation from a page of ours carrying the single-use link token that page rendered, it must not come from a datacenter address, and it must be the first such click on your listing from that visitor that day. A click that fails those checks is still delivered — the visitor still reaches you — and simply costs you nothing.
- A daily cap limits how many years your listing can spend in one day. It defaults to 200 and only you can change it. Clicks beyond the cap are still delivered and do not burn.
- For the first 24 hours after a listing enters the board, clicks cannot take its balance below one year.
- Where an hour's charged clicks run far beyond that listing's own recent pattern, we may freeze charging on it for a period. Clicks keep being delivered while it is frozen; they stop being charged. You may lift a freeze yourself from the dashboard.
- We may credit years back to a listing where we believe it was drained by activity that was not genuine. We do so at our discretion and it does not create an entitlement.
We do not guarantee any number of clicks, visitors, impressions or conversions, and we do not guarantee any position on the board. What we sell is the carrying of your listing and the delivery of the clicks that occur, not an audience of a given size.
7. Upkeep, the tick, and beheading
- Every listing standing on the board is charged ten years per day in upkeep, whether or not anyone clicked it.
- Upkeep is charged in a single daily sweep at 12:00 UTC (the "tick"). A listing whose balance is at or below zero at the tick is beheaded: it is removed from the board and recorded in The Fallen with the date. This is the only moment at which a listing is removed for having no years, so no burst of traffic can remove one.
- Buying years for a beheaded listing returns it to the board with the years bought. Years the listing held before it fell are spent, and the record of the fall remains.
- A listing that has stood 48 hours without a single click is taken off the board until a click is delivered to it. It keeps its years, and the redirect keeps working.
8. The Gathering
- Listings compete within a Gathering, a season lasting seven days from the moment it opens. The closing time is set when the Gathering opens and is never changed.
- A Gathering ends when one immortal remains standing, or when its closing time passes, whichever comes first.
- The last one standing, or on the clock the highest remaining balance among the living, is the victor and receives permanent placement in the Hall, including a link to the URL as submitted. The Hall placement is provided as long as we operate the service and carries no other entitlement.
- When a Gathering closes, each living listing's remaining balance is carried into the next one. Nothing crosses between listings.
9. Payment, VAT and expiry
- Years are bought in a single payment through Stripe Checkout. Nothing recurs and there is nothing to cancel. We are the merchant of record and Stripe issues an invoice.
- Prices are shown net. VAT is added on top where it applies; where the reverse-charge procedure applies to a verified business customer, it is applied. VAT is accounted for when you buy years, not as they are spent — a year entitles you to one service at one rate with a known place of supply.
- Unspent years expire twelve months after the purchase that created them. Expiry removes them from the balance and is not refunded.
- Any free grant expires when the listing leaves the board and is never refunded.
- Anyone may buy years for any listing. The years are credited to that listing and never to the payer, and buying years for a listing gives the payer no rights over it.
10. Refunds, chargebacks and discontinuation
- A purchase of years is a purchase of a service to be delivered. We are not obliged to refund years already spent.
- Where you have unspent years and ask us to, we may refund them at the price actually paid for the pack they came from, less any part already delivered. We decide such requests case by case; this paragraph does not create an entitlement and does not affect rights that cannot lawfully be excluded.
- A chargeback removes the years it paid for. Where a payment is charged back, reversed or refunded, the corresponding years are debited from the listing's balance. If they have already been spent, the balance may go negative and the listing may be beheaded at the next tick as a result.
- Removal under § 12 for content that breaches these Terms is not refunded.
- If we discontinue the service, we will stop selling packs immediately and give at least 30 days' notice before the board closes. Years unspent at the end of that period will be refunded in proportion to the price paid for the pack they came from. This is our stated position on discontinuation and is not affected by § 9's expiry rule for the notice period itself.
11. What may be listed
A listing consists of a title (up to 80 characters), a description (up to 200 characters) and a destination URL. It is published without prior review. You must not submit:
- content or destinations that are unlawful in Germany or the European Union;
- malware, phishing, or deceptive download or payment pages;
- content infringing a third party's trade mark, name, or other rights, including a title or URL belonging to someone else, or a title that misrepresents the identity of the linked business;
- pornography, gambling without the required licence, weapons, illegal drugs, or content harmful to minors;
- content that is defamatory, discriminatory, or incites hatred.
You warrant that you are entitled to use the title and URL you submit, and that the destination remains within these limits for as long as the listing stands. We may remove any listing that breaches this section, without refund, and may close the account behind it.
12. Unlawful content: notices and action
Anyone may report a listing. Signed-in listers who hold a verified, standing listing of their own can do so with the report button on any listing page; three distinct such reports take a listing off the board pending review. Anyone else may report by e-mail to mail@haukejung.de, stating the listing's URL on Highlander, the content complained of, and the reason it is unlawful, with contact details for follow-up.
The report button and that mailbox together are our notice-and-action mechanism under Article 16 of Regulation (EU) 2022/2065 (Digital Services Act). We will confirm receipt, decide without undue delay, inform the notifying party of the outcome, and inform the affected lister of any removal together with the reason (Article 17). Our point of contact under Articles 11 and 12 of that Regulation is mail@haukejung.de, in German or English.
13. Advertising: how the board is labelled
Every listing on the board is paid placement, and the board says so. Order on the board is bought: rank is the number of years a listing has remaining, and years are bought from us. We do not present the board as an editorial ranking, a recommendation, a rating, or a measure of quality, and neither may you.
- Listings link to their destination through a redirect on our host, marked
rel="sponsored nofollow". They are advertising and are marked as advertising (§ 6 DDG, § 22 MStV, § 5a (4) UWG). - The single exception is the Hall: a victor's link is a dofollow link, which is the substance of the Prize.
- You must not describe a position on the board as an award, an endorsement, or an independent ranking in your own marketing.
14. Availability
We aim to keep the service available but do not warrant uninterrupted or error-free operation. Maintenance, third-party outages (in particular Stripe, our identity provider, and our hosting provider) and force majeure may interrupt it. Downtime does not by itself entitle you to a refund, save where it is attributable to our intent or gross negligence. Days on which the board was unavailable are still charged upkeep unless we state otherwise.
15. Intellectual property and display
The platform, its code, design and documentation remain our property or that of our licensors. You receive a non-exclusive, non-transferable right to use the service in accordance with these Terms.
You grant us a limited right to display your listing's title, description, domain and destination link on our own pages and in the share cards generated for them, together with its rank, its remaining years, the date it entered, the date it fell if it did, and any victory it won. That record stays published after the listing leaves the board.
16. Liability
- We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, and where we have given a guarantee.
- For slight negligence we are liable only for breach of a material contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely), and then only for foreseeable damage typical of this type of contract.
- All further liability is excluded.
- Subject to the two paragraphs above, our aggregate liability for all claims arising in any twelve-month period is limited to the amounts you paid to us in that period.
- We are not liable for the content, conduct or availability of any destination linked from the board, nor for the traffic any listing receives or fails to receive.
17. Term and termination
- A listing ends when it is beheaded, when you remove it, or when we remove it under § 11. You may stop at any time; there is nothing to cancel and no notice period.
- We may suspend or terminate access for breach of these Terms, non-payment, or legal or security risk. The right to terminate for good cause remains unaffected.
- Termination does not create a right to a refund of years already delivered. § 10 governs what happens to unspent years.
18. Governing law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where you are a merchant, a legal person under public law, or a special fund under public law, the exclusive place of jurisdiction is Freiburg im Breisgau, Germany.
19. Changes, severability, entire agreement
- We may change these Terms where required by law or by changes to the service. Registered users will be notified at least 14 days before material changes take effect, and continued use after that date constitutes acceptance. A purchase is governed by the version in force when it was made, and a later change cannot alter it.
- If any provision is or becomes invalid, the remainder stays in force.
- These Terms, together with the Privacy Policy, constitute the entire agreement between us regarding Highlander.
